I was in a car accident 4 days ago. My Mother was the passenger in my car (I was driving). I was on the off ramp getting off the freeway. All cars behind me were stopped. I was stopped waiting to make a right turn. An emergency vehicle was coming in my direction from my left. Therefore, I was waiting for the emergency vehicle to pass. The person behind me (large dodge ram truck I am in an '08 2 door Infiniti coupe) thought I went so he 'gunned it' to get in front of the emergency vehicle. Unfortunately, we had not gone so he pushed my vehicle out in front of the emergency vehicle. Luckily, I was able to turn my car out of the way. I did not hit anyone (no one was in front of me). My Mother and I were both put into a gurney and taken to a local hospital in an ambulance. We both had our seat belts on and suffered whiplash. We were released 5-6 hours later after x-rays, etc. We were both prescribed medicine. My Mother has had 3 brain tumors and has trouble with her speech etc. and any violent startling trauma can get her shaken up pretty badly and confused. I know she hit her head but, she is in pain but not nearly as much as I am. With my Mother's condition I don't know if this kind of thing can have negative effects later on. I know that my neck and back is pretty messed up. It hurts to stand for after 15 minutes or so. My car is pretty messed up and had to be towed. I plan on taking it back to the Infiniti shop to get all new parts. My car has all the upgrades in it so I want it to be taken care of. Am I allowed to take it to the Infiniti dealership or will Geico (the other persons insurance) not allow that, or does it not matter? The police gave the guy that hit us a citation. I have USAA and the other person has Geico. I just want to know exactly what to do in this situation. Since I'm out a car (I work for myself) I have been out (already) a decent amount of money for not being able to meet up with my clients. I spoke to my insurance today and they said that all my medical is covered since I had that already in my plan (without it raising my premium) and that I should get a settlement ON TOP of paying for damages to my car and getting me a rental, etc. Any advice would be greatly appreciated. I was hit from behind on Wednesday evening heading to work. The driver was ticketed by the police and their insurance company has admitted full liability. So I've had the car for a year and half, taken out on a 5yr car loan. I still owe 12k on it. After they cut a check to the lean holder, I'm still responsible for 5k on that loan. The bank and my insurance at the time didn't offer gap insurance. Stupid of me, I let my current policy expire to search around for a more affordable policy. I kept procrastinating, and the accident happened with me having no insurance. Lucky he hit me and is at fault. I'm trying to see what my options are. I've gone to the liable company's website and see their basic plan for my state, law requires 25k in property liability for at fault accidents, plus medical etc. So I'm wondering what should I expect from the lady handling this claim. I'm not fooled when she called me yesterday and said that she is here to work with and for me. Saying that there is probably a lot of talk about lawyers, just know they will take 30-40% of you settlement. Know that I'm here to work for you, try to work with me I'm thinking my head total bull crap. 1, she works for her insurance company first, and will have their interest first, 2, she works for their client and to protect them from me in a suit. In the end, I'm not stuck with a car that they will not fully pay to have repaired, and will still owe 5k after they pay the loan holder the value of the car. My credit is damaged and getting a new loan is probably not going to happen easily. I really don't want to get a lawyer but I now have a car sitting in my driveway that I can't use plus a balance in the end. Anyone got some suggestions as to what I should realistically expect. My sister said I should take out at least 2x my pay off on my house so that I could pay it off and still have 100,000 to cover financial issues until the parent left could settle in to taking care of a house hold alone. Do you agree? Should we increase our policies? I co-signed a car loan for a friend of mine, he went to get the registration and all that but he couldnt register it unless I am on the insurance, and the registration. The dealer is threatening to take the car back from him if he doesnt come to the dealer proving that I am on all the necessary documents. Registration, and insurance. I am not driving this car at all and we also live in two seperate cities, and only did this to help him establish some sort of credit rating again, but this has ended up being a huge pain in the ***. One Idea I had was to write a bill of sale up saying that I have sold him the car and he is now the owner of the car, not me.
